قرار رئيس جمهورية مصر العربية رقم 9 لسنة 2024 بشأن الموافقة على الملحق رقم (2) للاتفاق الإطارى بين حكومة جمهورية مصر العربية والوكالة الفرنسية للتنمية الموقع فى 19 أبريل 2006 بشأن إدراج مؤسسة الخبرة الفرنسية ضمن مجموعة وكالة التنمية الفرنسية رئيس الجمهورية بعد الاطلاع على نص المادة 151 من الدستور ؛ وبعد موافقة مجلس الوزراء ؛ قرر : (مادة وحيدة ) ووفق على «الملحق رقم (2) للاتفاق الإطارى بين حكومة جمهورية مصر العربية والوكالة الفرنسية للتنمية الموقع فى 19 أبريل 2006 بشأن إدراج مؤسسة الخبرة الفرنسية ضمن مجموعة وكالة التنمية الفرنسية» وذلك مع التحفظ بشرط التصديق . صدر برئاسة الجمهورية فى 4 رجب سنة 1445 هــ ( الموافق 16 يناير سنة 2024 ) . عبد الفتاح السيسى وافق مجلس النواب على هذا القرار بجلسته المعقودة فى 16 شعبان سنة 1445 هــ (الموافق 26 فبراير سنة 2024 م) . ملحق رقم (2) للاتفاق الإطارى بين حكومة جمهورية مصر العربية والوكالة الفرنسية للتنمية الموقع فى 19 أبريل 2006 (يشار إليه فيما بعد باسم «الملحق») بين : حكومة جمهورية مصر العربية (يشار إليها فيما يلى باسم «مصر») تتمثل بالسيدة/ رانيا المشاط ، بصفتها وزيرة التعاون الدولى المعتمدة على النحو الواجب لهذا الغرض ، من ناحية ؛ و وكالة التنمية الفرنسية (يشار إليها فيما يلى باسم «AFD») مؤسسة عامة فرنسية ، مسجلة فى السجل التجارى والتجارى فى باريس تحت رقم B775665 599 ، ومقرها فى 5 شارع Paris Cedex 1275598 ، Roland Barthes ، فرنسا ، تتمثل بالسيدة كليمنس فيدال دى لابلاش، بصفتها مدير مكتب الوكالة الفرنسية للتنمية المعتمدة على النحو الواجب لهذا الغرض ، و مؤسسة الترويج والمشاركة للتعاون الاقتصادى «بروباركو» (يشار إليها فيما يلى باسم «PROPARCO») شركة فرنسية مسجلة فى سجل التجارة والشركات بباريس تحت رقم 310792205 ومقرها 151 شارع سان أونوريه ، 75001 باريس ، فرنسا ، يتمثل بالسيده فرانسواز لومبارد ، بصفتها المديرة التنفيذية لمؤسسة بروباركو المعتمدة على النحو الواجب لهذا الغرض ، و مؤسسة الخبرة الفرنسية (المشار إليها فيما يلى باسم «Expertise France») شركة فرنسية ذات حوكمة عامة ورأس مال ، مسجلة فى سجل التجارة والشركات بباريس تحت رقم 808734792 ومقرها الرئيسى يقع فى 40 بوليفارد دى بورت رويال ، 75005 باريس ، فرنسا يمثلها السيد جيريمى بيليه ، المدير التنفيذى لمؤسسة الخبرة الفرنسية المعتمد على النحو الواجب لهذا الغرض . على الجانب الآخر، لأغراض هذه الاتفاقية، يشار إلى مصر والوكالة الفرنسية للتنمية وبروباركو ومؤسسة الخبرة الفرنسية باسم «الأطراف». بالنظر إلى أن مصر من جهة، والوكالة الفرنسية للتنمية (AFD) ومؤسسة بروباركو Proparco من جهة أخرى (يشار إليهما معا باسم «مجموعة الوكالة الفرنسية للتنمية AFD») قد وقعتا اتفاقا إطاريا فى 19 أبريل 2006 وملحقًا رقم 1 للاتفاق الإطارى هذا فى 23 نوفمبر 2019 (يشار إليهما معًا فيما يلى باسم «الاتفاق الإطاري») ؛ حيث أن مجموعة الوكالة الفرنسية للتنمية تلعب دورًا مركزيًا فى النظام الفرنسى للمساعدات العامة للدول النامية وأنها تتابع أنشطتها فى أكثر من 80 دولة من خلال شبكتها التى تضم حوالى 60 تمثيلاً محليًا أو نحو ذلك ؛ حيث أن مؤسسة الخبرة الفرنسية هى وكالة عامة مشتركة بين الوزارات للتعاون الفنى الدولى الفرنسى ، واعتبارا من 1 يناير 2022 ، كيان من مجموعة الوكالة الفرنسية للتنمية (AFD). تقوم بمهمة الخدمة العامة ورأس مالها 100 % مملوك من قبل الوكالة الفرنسية للتنمية ، وفقا لأحكام القانون رقم 2021-1031 المؤرخ 4 أغسطس 2021 بشأن البرمجة من أجل التنمية الشاملة ومحاربة التفاوتات العالمية ونظامها الأساسى ؛ حيث تساهم مؤسسة الخبرة الفرنسية، من خلال استكمال إجراءات مجموعة الوكالة الفرنسية للتنمية ، فى تحقيق أهداف التضامن الدولى وسياسة التنمية فى فرنسا من خلال تصور وتنفيذ مشاريع فى هذا المجال، من شأنها تعزيز السياسات العامة بشكل مستدام فى قطاعات مثل الحوكمة ، النمو الاقتصادى ، المناخ والتنوع البيولوجى أو الصحة أو التنمية البشرية ؛ حيث يتم تمويل عمليات خبراء فرنسا من قبل مانحين ثنائيين ومتعددى الأطراف ولا سيما الدولة الفرنسية - على وجه الخصوص ، من خلال الوكالة الفرنسية للتنمية، والاتحاد الأوروبى ؛ حيث أن ، فى هذا الإطار ، تقوم مؤسسة الخبرة الفرنسية باستعانة الخبراء الوطنيين والفرنسيين والدوليين ، وتتدخل في المراحل الرئيسية لدورة المشروع (التحديد والصياغة والتنفيذ والمراقبة) وتقدم مجموعة واسعة من التدخلات فى هذا المجال (توفير الخبرة طويلة المدى ، وتنظيم ورش العمل ، والندوات ، والدورات التدريبية ، والزيارات الدراسية ، وما إلى ذلك) على أساس نهج متكامل للسياسات العامة ؛ ورغبة منها فى الأخذ بعين الاعتبار الإدماج الفعال لمؤسسة الخبرة الفرنسية فى مجموعة الوكالة الفرنسية للتنمية من خلال منح مؤسسة الخبرة الفرنسية نفس الوضع المحدد الذى تتمتع به مجموعة الوكالة الفرنسية للتنمية على أراضى مصر ؛ قد اتفقت على ما يلي : (المادة 1) الغرض من الملحق تدرج مؤسسة الخبرة الفرنسية ضمن مجموعة وكالة التنمية الفرنسية المذكورة فى الاتفاق الإطارى بين حكومة جمهورية مصر العربية ووكالة التنمية الفرنسية الموقع فى 19 أبريل 2006 (المادة 2) الامتيازات والإعفاءات تمتد الامتيازات والإعفاءات التى تمنحها حكومة جمهورية مصر العربية لمجموعة الوكالة التنمية الفرنسية على إقليمها بموجب أحكام وشروط الاتفاق الإطارى بينهما لتشمل مؤسسة الخبرة الفرنسية، وكذلك للموظفين الأجانب الدائمين الذين توظفهم الأخيرة، إلى الحد المطلوب لإنجاز مهامها. (المادة 3) أحكام مكملة للإتفاق الإطارى يتم إرفاق هذا الملحق بالاتفاق الإطارى المشار إليه بالمادة (1) ويعد جزء لا يتجزأ منه . (المادة 4) الدخول حيز النفاذ والمدة يدخل هذا الملحق حيز النفاذ طبقا لنفس ذات الشروط المذكورة فى المادة (17) من الإتفاق الإطارى المشار إليه بالمادة (1). تكون مدة الملحق هى نفس مدة الاتفاق الإطارى. ينطبق هذا التعديل على العقود المعلقة التى أبرمها أى كيان تابع لمجموعة الوكالة الفرنسية للتنمية فى مصر. (المادة 5) الإستمرارية تستمر أحكام الإتفاق الإطارى الموقع فى 19 أبريل 2006 والمعدل بالملحق الموقع فى 23/11/2019 بين حكومة جمهورية مصر العربية ووكالة التنمية الفرنسية ومؤسسة الترويج والمشاركة للتعاون الاقتصادى (PROPARCO) وكما تم تعديله وفقا لهذا الملحق سارية وفعالة كما يلزم قراءتها وتفسيرها مع هذا الملحق كمستند واحد. تم التوقيع فى القاهرة بتاريخ 13/9/2023 من أربع أصول متساوية فى الحجية باللغات العربية والإنجليزية والفرنسية. فى حالة وجود أى خلاف فى التفسير، يعتد بالنص الإنجليزي. حكومة جمهورية مصر العربية يمثلها السيدة الدكتورة/ رانيا المشاط وزير التعاون الدولى وكالة التنمية الفرنسية يمثلها السيدة/ كليمنس فيدال دى لابلاش مديرة مكتب الوكالة الفرنسية للتنمية مؤسسة بروباركو يمثلها السيدة/ فرانسواز لومبارد المديرة التنفيذية مؤسسة الخبرة الفرنسية يمثلها السيد/ جيريمى بيليه المدير التنفيذى ‏ANNEX N°(2) to ‏the Framework Agreement between the Agence Française de Développement ‏and the Government of the Arab Republic of Egypt ‏signed on April 19, 2006. ‏(referred to hereinafter as «the Annex») ‏BETWEEN: ‏THE GOVERNMENT OF THE ARAB REPUBLIC OF EGYPT ‏(referred to hereinafter as «Egypt») ‏Represented by Dr. Rania A. It performs public service mission and its share capital is 100% ‏public and held by the AFD, in accordance with the provisions of Law n°2021-1031 of August 4, ‏2021 on programming for inclusive development and the fight against global inequalities and its ‏article of association; ‏RECALLING THAT, Expertise France contributes, by complementing the actions of AFD ‏Group, to the achievement of the objectives of international solidarity and the development policy ‏of France by conceiving and implementing projects in the field, that sustainably strengthen public ‏policies in sectors such as governance, economic development, climate and biodiversity, health or ‏human development; ‏RECALLING THAT, Expertise France operations are funded by bilateral and mul-tilateral donors, ‏mainly the French State - in particular, through the Agence française de développement, and the ‏European Union; ‏RECALLING THAT, within this framework, Expertise France mobilises national, French and ‏international experts, intervenes in the main phases of the project cycle (identification, formulation, ‏implementation and monitoring) and offers a wide range of interventions in the field (provision of ‏short and long term expertise, organisation of workshops, seminars, trainings, study visits, etc.) ‏based on an integrated approach to public policies; ‏WISHING to take account of the effective incorporation of Expertise France into the AFD Group ‏by conferring on Expertise France the same specific status as that en-joyed by the AFD Group on ‏the territory of Egypt; ‏Have agreed what follows: ‏Article 1 ‏Purpose of the Annex ‏Expertise France is inserted in the AFD Group mentioned in the Framework Agreement signed ‏on April 19, 2006 between Egypt and the AFD Group. ‏Article 2 ‏Privileges and exemptions ‏The privileges and exemptions granted by the Government of Arab Republic of Egypt to the AFD ‏Group on its territory, under the terms and conditions of the Frame-work Agreement between ‏them, shall be extended to Expertise France, as well as to foreign permanent staff employed by the ‏latter, to the extent required for it to accom-plish its missions. ‏Article 3 ‏Complementary terms to the Framework Agreement ‏This Annex shall be appended to the Framework Agreement mentioned I Article (1), of which it ‏shall constitute an integral part. ‏Article 4 ‏Entry into force and duration ‏The present Annex shall enter into force according to the same conditions men-tioned in article (17) of the Framework Agreement mentioned in article (1) and the period of the Annex is the same ‏period as the Framework Agreement. ‏This Amendment applies to outstanding contracts entered into by any entity of the AFD Group ‏in Egypt. ‏Article 5 ‏Continuity ‏The provisions of the Framework Agreement signed on April 19, 2006 and the addendum n°1 ‏signed on November 23, 2019 between the Government of the Arab Republic of Egypt, the French ‏Development Agency and PROPARCO, and as amended in accordance with this Annex, shall ‏continue to be valid and effective and must be read and interpreted with this Annex as a single ‏document. ‏Signed in , on / / 2023 ‏in four originals, in the Arabic, English and French languages, three of which ‏are equally authentic.
